Having the cake

Let me share a little story about Jejomar Binay from last February 25, when I recounted this, from the Ayala Avenue march:

Yesterday was about linking arms with poor people, rich people, normally politically indifferent people and activists, people with views different from my own but who, at least, aren’t cowardly collaborators or simple-minded apologists of the current dispensation. It was about moving forward along Ayala Avenue at time inch by inch, foot by foot: seeing, every few meters, the policemen menacingly blocking our way. At one point, I was an arm’s length away from batons being aimed at us from behind riot shields; and then cheering as the shields retreated, only to regroup. It was about feeling a particular kind of fury, at seeing ordinary policemen being given the extraordinary mission of defending Ninoy’s statue from the homage of his widow.

We’d been, as I recounted, inching along, with only four or so rows of people ahead of us. All of a sudden, the first row was confronted by riot police and the riot police began swinging their clubs. The first row staggered back and merged with the second row, even as the third row merged with the second because of its forward momentum. So those of us in the fourth row found ourselves instantly the new second row. You could feel the air being displaced by the billy clubs of the riot police, and I remember observing, rather clinically, that the police were clubbing people rhythmically: whack… then a pause as they lifted their batons… then whack… and their was a kind of rhythmical counterpoint as those in their line of beating thudded against the riot shields of the cops.

The instinct at such times is to link arms even tighter and hunch your shoulders in preparation for being struck; and then to straddle the ground to make sure you don’t topple backwards.

Then there was commotion behind us, and I looked back to see the rows behind us part as Mayor Binay came barreling forward, frantically pursued by supporters. He ducked his head, squared his shoulders, zipped through our line and the line ahead, and single-handledly charged the policemen. Just like an American football player. There was a kind of slap as his forearms collided with the riot shields, and then it was the line of policemen that staggered back -and kept staggering back until some officers jumped in to hold the policemen back. At which point the cheering began from our ranks. Then Binay met with the officers and they pulled back. When they’d regroup to try to stop us again, Binay would charge ahead, the cops would pull back, until finally he negotiated access to Ninoy’s statue.

I have rarely seen such raw, physical courage.

But what of the case against Binay? A friend under bar whose opinion I sought said it was simple: the Local Government Code is pretty inflexible on the matter. If anyone files a complaint against a local official, it’s the duty of the authorities to suspend that official. The idea being, to prevent the destruction of evidence. All the law requires is that proper procedure be applied in the filing of the complaint. It is up to the courts to look into the matter, if appealed to, to determine if there was a grave abuse of discretion involved in the suspension of the official.

The code only protects officials to the extent that there is a fixed duration for suspensions, and that the cause for one suspension can’t be recycled -to prevent an endless series of suspensions to harass an official.

So what’s wrong with the Binay suspension? Read Newsbreak’s analysis of the case -besides questions over the procedures followed, it’s unprecedented in that an entire city administration was decapitated. And since what is legal isn’t necessarily what’s right -something lawyers often forget- the many billions of reasons the action could be flawed, is spelled out in the article, too:

It appears that the Palace acted too swiftly on Binay.

Section 63 of the Code says that a preventive suspension, which should not exceed two months, may be imposed “after the issues are joined,” “when the evidence of guilt is strong,” and when the official’s stay in office may influence the witnesses or dissipate the evidence against him.

Legally, issues are considered “joined” after both parties have presented their side to a specific case. Binay and his council submitted their reply to the complaints on September 27. However, if the term is strictly defined as airing of sides and presentation of evidence, then Malacañang cut short the process – it has not conducted any hearing, which the Code requires should be conducted where Binay and the council holds office.

So why the rush?

The administration doesn’t keep it a secret that it wants to Binay out of City Hall – but not because they perceive him to be corrupt, as his critics and official audit reports have been trying to prove…

But in their consultations, President Arroyo’s political strategists have acknowledged that even if they field a former actor for a candidate, pour in so much money, and engage in special operations during the campaign and election next year (assuming one will be held), they wouldn’t be able to defeat Binay and his slate. Their assessment was that the only way to weaken Binay’s machinery is to keep his hands off the city government’s huge resources before the campaign period, which starts in the last week of March 2007.

To accomplish this, the administration has to race against time.

For one, local government units propose their budgets for the following year in October of the present year. Since 2007 is an election year, its budget that has to be studied and prepared starting this month will be open to discretionary items that could be used in campaign-related matters. Makati is the richest city in the country in terms of collection (excluding its share in the internal revenue allotment). It has reportedly been registering an average of P3 billion in surpluses annually since 2001.

For another, Section 62-c of the Code says that no probe for administrative charges should be held, and therefore no preventive suspension can be served, within 90 days before an election. Since the next local elections is scheduled for May 14, 2007, there can be no investigation or preventive suspension against Binay starting mid-February next year. The Palace therefore has to start the probe now.

If the 60-day preventive suspension expires while the OP has yet to complete its investigation, Binay is reinstated. Although his return to office doesn’t stop the investigation, the Palace’s fear of the mayor using his seat to influence witnesses and destroy evidence against him may be realized.

There you have it. As I said in my column for today, it’s about Having the cake.

  1. The current political harassment from the Palace against a known opposition figure is really a shameful act that was made to further degrade the democratic institutions in our country. In the first place, the “issue of ghost employees” is a national issue that is haunting the national government, including the presidential palace, the cabinet secretaries’ offices and almost all of the local officials’ offices throughout the country. The issue of ghost employment in the Philippine government is a national problem that has to be resolved. Why single out Makati City only? Why not begin the process at the Malacanyang Palace? And why is it that there is a “swift process of investigation” for opposition figures as compared to the “slow process of investigation” against known administration officials? When will Mrs. Arroyo herself face an honest-to-goodness investigation process that will determine the legitimacy of her presidency? As I’ve said before, Mrs. Arroyo has a credibility problem that makes her presidency become so bankrupt in upholding moral values. Such presidency has no moral basis to suspend local officials on the basis of mere suspicions only. Mrs. Arroyo should advocate political abrogationism herself, so that she can wage a real campaign for the gaining of real and moral democracy in our country. Political abrogationism is the advocacy of peaceful and lawful abolition of all types of dictatorships, monarchial reigns and despotic regimes all over this world. Political abrogationism also preaches that every country, every social organization and every culture in our world should peacefully and lawfully embrace real and moral democracy. Mrs. Arroyo can know more about political abrogationism by typing and clicking the word “political abrogationism” at any internet search box that is available. Mrs. Arroyo should be advised by Sec. Puno to stop making despotic policies that continuosly degrade the democratic institutions in our country. Sec. Puno should quit his post if he can’t say that to Mrs. Arroyo.

    All the legal, progressive and peaceful groups in our country should ask the presidency to stop harassing Mayor Jejomar Binay. Let Binay serve his term as mayor of Makati without political harassment from a questionable presidency. Let Mrs. Arroyo face an investigative body that will determine the legitimacy of her presidency.

    The Japanese attack on Pearl Harbor was treachery, so are GMA’s unabated attacks on our democratic institutions a continuing treachery.

    On going is an undeclared war by Gloria and her loyalists against the Filipino people — salvagings, kidnappings, state terrorism,

    Control of Makati, the country’s financial center, is crucial for a tighter control of the entire country.

    If Filipinos of Makati and Filipinos from other parts of the country choose to make a stand and fight for democracy, they will be massacred.

    Marcos and Erap did not order the troops to shoot at the crowd, GMA will. GMA loyalist generals are ready too shoot at the people or bomb them.

    GMA loyalists are conditioning the public about a terrorist attack in the Metro. PNP is on red alert.

    For all his courage, the shedding of blood of his people is what will make Binay back down. What agony must a man of conscience experience; what composure could a cold-blooded tyrant poses.

    Only millions can protect the few brave men who standing up against the tyrant.

    Converge in Makati, gather in town plazas , intersections, rotondas. Boycott classes, go on general strike, work stoppages, transport strike…

    It’s sad that a city’s (or a province’s, or a country’s) resources are treated as personal campaign funds during election periods. GMA knows this fact only too well, as the fertilizer scam and allocation of public funds (such as pork) for allies attest. Binay might be our son-of-a-bitch, but I want my son-of-a-bitch to rise above this dubious practice of using public funds as personal campaign funds. I condemned GMA for doing this. I expect more from our sons-of-bitches. Am I wrong in doing so?

  7. Should we be surprised that Mayor Binay was suspended? After all, he’s one obvious target of Gloria Arroyo’s wrath. My only fear is that, many of us would just see this as a simple matter of local government mismanagement. I come from the province of Zamboanga. You bet, Gloria Arroyo’s guns should have been focused here first than in Makati. That is, if you talk about mismanagement. But I’m sure she will not. They all kiss Gloria’s ass bigtime. Clappers you could say during the SONA. To you Mr. Quezon, be brave like you always do, against this kind of national leadership. Gloria Arroyo’s kind is like a plague. I just hope she’s out for good and all her likes come 2010 or much earlier. Just in time my daughter gets to understand enough about politics.

  10. Binay’s suspension was clearly out of prejudice, contrary to what DILG and Secretary Ermita are claiming. He is, after all, the president of the United Opposition. Binay’s and Peewee Trinindad’s suspension orders are just the starting point (God forbid) of an extensive administration crackdown on opposition leaders.

    Government is turning into a dictatorship….it is a fledgling dictatorship, no matter how much they deny it. It started with 1017, and Chacha set the stage. Now, to ensure she would stay in power, Arroyo is aiming for those who have the capacity to gather the people against her.

    Notwithstanding the fact that 6B in the hands of administration lackeys are more than enough to fund their own political agenda.

    I salute you, Mr. Quezon, for your courage in writin about this. Kinda inspired me to write something about it, too.

  14. NOW THAT A TRO WAS ISSUED, THE DILG IS COURTING CONTEMPT

    The DILG is courting contempt when its undersecretary Wencelito Andanar said that the TRO issued by the Court of Appeals against the preventive suspension of Makati mayor Jejomar Binay an hour ago is of no consequence as to them since according to Andanar they had already served the notice of suspension. He said the CA has to issue a mandatory preliminary injunction to set aside the preventive suspension.
    A TRO is a temporary prohibition (in this case, for 60 days). When a law, resolution, order, is issued by a government agency or any entity; and a party thinks that he/she has a clear, legal right that’s being violated by said law, resolution, order, he/ she files a petition for certiorari and prohibition with a prayer for a preliminary injunction and TRO. (the short cut of that when you’re writing a news story is, it’s an injunction case). Prohibition. It means to stop.
    The opposite of that is a petitition for certiorari and mandamus with a prayer for a preliminary mandatory injunction. (What Andanar was talking about).The tip I give my students so they would remember this is: what is the root word of mandamus? It’s Latin. I tell my students some of these Latin words i think have Tagalog counterparts. I think; I’m no authority on the Tagalog words, I just think; litis pendentia means pending litigation. In Tagalog, we have a word: “paglilitis” which means hearing or litigation, it’s similar, right? So, mandamus, for my students, I tell them it’s similar to “imando mo sila” which means “utusan mo sila” or “brasuhin mo” “to armtwist them”, “imando mo”, to order them; it’s similar, right? So that’s how my students become unafraid of legalese and remember the concepts.
    So, here, a temporary prohibition was issued by the CA. A TRO is a prohibition. The CA has temporarily prohibited the DILG and concerned parties from, (quote) “implementing and enforcing the preventive suspension order” for 60 days.
    It means the DILG and other concerned government agencies are ordered to stop the enforcement of the order, to cease, to desist, from further doing the suspending.
    A mandatory injunction, or mandamus, is the opposite of that; it means they should do something or begin to do something. For example, if a party has complied with all the requirements for the issuance of a permit or license that he/she is entitled to, and the government agency, for no reason at all, refuses to release any license, permit, or property, that the party is entitled to by right, a mandamus would lie. To order the government agency to do something.
    Even a student knows that; and here the DILG is showing an astounding degree of lawlessness.
    It thinks it is the law.

    5) Grave threat to life and property

    whatever…

    real damage was done to the City of Makati – its gov’t and its citizens.

    “an illegitimate national government official” is more precise, my correction was not entirely correct neither is “an illegitimate government” entirely wrong because the way the illegitimate official managed to stay in power and run the government has rendered the government an instrument of oppression against the people as if the government itself has become illegitimate, like an occupying force, an invasion, a colonial government or a criminal syndicate that hi-jacked a government.

  18. MLQ3- I’m intrigued by the passage which appears in your homepage under the “Having the cake” heading. It’s not in your actual blog entry, and it seems to be castigating Binay for grandstanding at Andanar’s expense. So where’s it from?

    While it was Binay who is accused of retaining ghost employees, it was also Binay who was throwing accusations that his suspension is politically motivated—part of the so-called concerted moves of the administration to get rid of elements of the opposition.There is a saying to describe such a passage -refusing to see the forest from the trees. Or take the passage that follows the one just quoted:In that particular segment of the Binay-Andanar phone patches, Andanar was not even a direct party to the issue; he was merely assigned to enforce the order of suspension…. Throwing the term at Andanar, live on national TV, knowing fully well that Andanar could not legitimately grant nor deny the demand for a Bill of Particulars, was clearly nothing but grandstanding on the part of Binay.

    Ah, but we mustn’t underestimate Gloria’s determination to hold on to power at all cost. She has a vast reserve of tricks to “shoot” down her enemies – the elections are a few months away after all.

    But Rizalist over at Philippine Commentary is optimistic and while I share his optimism (after all 2 black eyes in a row on Gloria isn’t a little thing), Binay will have to come up with more than a military outfit trick to stare down a potential incoming onslaught.

    But I bank on Mlq3’s judgement of Binay’s character to do that: one possessing raw courage. Let’s hope the other friends of the mayor have the moral courage to back him up to the hilt.

  23. Tony, When I got that pneumo-vaccine, the nurse told me (a) those who have not had any, should get the shot. (b) The first shot is good for a lot of years. No need for the second shot until one turns 55. [But the sicker-than-normal (e.g. diabetes, heart-problems, HIV, etc) should get the vaccine every 5 years).

    20% casualty rate (40/200 or 1/5) so getting the vaccine makes sense. As you said… talk to your doctor.

  24. Jejomar Binay may be no saint but his alleged crookedness certainly pales in comparison with that of any of the administration’s candidates for his replacement. And as for his “raw, physical courage”, as MLQ nicely put it, you can definitely count on it. Malacanang may be trying to bite more than it can chew this time. This one promises to be a real showdown and as for Binay’s sporting the military uniform with colonel’s rank, it reminded me of some of his comments he made during an interview we filmed in his office on 21st floor earlier this year:

    “A change in government through participation of people in uniform can never come from the generals because the generals will always demand to retain the status quo. And that´s why the coups that were successful in the past basically came from the colonels down – Nasir, the head of Libya (Qaddafi), these were colonels, they were not generals.”

    Could it be that “colonel Binay” is trying to inspire the young and restless in the military to join in? I suggest he wears a Magdalo armband as well since the much too obedient “guardians of the constitution” seem to be a little slow on the uptake lately.

    there is another way of viewing the situation…

    Gloria admirers can also see it as Gloria standing up against Binay’s raw force. Gloria can be viewed a courageous leaders And would even admire her even more for that.

    This is another issue that I woudl rather focus on the issues than on the personalities. Principles over emotionalism. Focusing on personalities will just results to never ending debates and kampihan. And a never ending showdown of what each personality has done, good or evil.

    I woudl rather simplify this issue to legalities. Did gloria violate any law when she prematurely suspended Binay? Did Binay violate any law defied the suspension issued by Binay?

    If all of these are just political manueverings of each protagonist???? well………..

    Going back to EDSA 1, did you admire Enrile and FVR or Marcos for not allowing bloodshed?
    Going back to EDSA 2, did you admire Erap for standing down to prevent bloodshed, or Gloria Arroyo, or Mike Arroyo, or the Chief Justice?

    Or didn’t you notice that a wrong course becomes the right course in the Philippines? (i.e. Ramos and Enrile defying their president, Arroyo defying Erap, etc.)?

    Or even in Thailand, the Coup d’etat was accepted. The new PM is now even scheduled to visit RP!

    Over at DJB’s Philippine Comentary, there’s a post that explains why the suspension order is void from the start, complete with legal references. Mayor Binay had reason to resist. It shouldnt even have come down to his asking for a ‘bill of particulars’. The suspension order itself if illegal.

  29. Upon learning that the CA had issued a TRO on Binay’s suspension, I immediately emailed the Court of Appeals congratulating Justices Enrico Lanzanas, Jose Reyes, Jr. and Edgardo Cruz of the 13th Division for letting constitutionalism triumph.

    The CA deserves the people’s gratitude for standing up to the lawlessness of GMA’s illegitimate government.

First, we started a war againts GMA, then when she and her gang recovered and started counterattacking we now complain and cry violation? harrassment ?etc. It is like boxing. She now got the judges(congress)and the security(military). One of the judges(senate)is ignored. At least the referee(SC) keeps on warning her but to no avail. The only way for her to be defeated out of the ring and the game is when the audience ignore the judges/security,climb the ring and throw her out of the coliseum. But the audience is not budging because they are split in many ways. Besides they do not have a champion they can trust.

  34. dear jm, schumey, anna de brux: thanks, thanks. for jm on class suit: unfortunately, GMA herself is immune from suit as president. she has to be impeached and convicted at her impeachment trial before she can be sued; or she has to resign, or be ousted; then she can be sued. class suits are civil in nature, i.e., for damages, (by the way, all crimes have a counterpart civil action for damages); it’s a class suit when the parties filing are too many, representatives can be chosen to stand for the entire community. yes, she can be sued, but only after she is no longer president.
